These Terms & Conditions govern your access to and use of the FXPertise website and the services provided through the platform.
1. Acceptance of Terms
By accessing the FXPertise website, creating an account, submitting an enquiry, placing an order, requesting a quote, making a payment, uploading documents, or otherwise using any FXPertise service, you agree to be bound by these Terms & Conditions and any applicable service-specific terms. If you do not agree to these Terms, you should not access or use the relevant website features or services.
2. About FXPertise
FXPertise Solutions Pvt Ltd ("FXPertise", "we", "us" or "our") provides international financial and travel-related services through its website and platform, including foreign currency exchange, international money transfer, forex cards, travel insurance, international SIM/eSIM services, and forex-as-a-service solutions for business and channel partners, subject to applicable laws and regulatory requirements.
3. Eligibility
Your eligibility to use a particular service depends on applicable law, RBI/FEMA requirements, KYC requirements, service-specific eligibility criteria, the purpose of the transaction, the documentation you are able to provide, and, where applicable, age and legal capacity to contract. FXPertise may refuse, restrict, or delay a transaction where required by law, regulation, internal compliance requirements, or the requirements of the relevant service provider or partner.
4. Services
FXPertise offers the following services through its website, subject to eligibility, availability and applicable terms:
- Foreign currency exchange — buying and selling foreign currency
- International money transfer / send money abroad
- Prepaid travel forex cards
- Travel insurance
- International SIM card / eSIM services
- Forex as a Service (FaaS) for eligible business and channel partners
- Currency converter and forex rate information
Availability of any service may vary by location, currency, customer eligibility, regulatory requirements, inventory, partner availability, and the applicable service/provider terms.
5. Foreign Currency Exchange
- Exchange rates can change based on prevailing market conditions.
- Rates displayed on the website may be indicative and are subject to change until an order/transaction is confirmed.
- Currency availability is subject to stock and operational availability.
- Transactions may require KYC and supporting documents.
- FXPertise may require additional verification before completing a transaction.
- The final applicable rate and charges will depend on the order/transaction confirmation.
6. International Money Transfer
International remittances and money transfers facilitated through FXPertise are subject to RBI requirements, FEMA, KYC, AML requirements, purpose and document verification, applicable transaction limits, beneficiary verification, processing by banks and payment partners, and applicable taxes and statutory charges.
Processing times are indicative and can be affected by banks, correspondent institutions, regulators, holidays, compliance checks, and other third parties involved in completing the transfer. FXPertise does not guarantee that every transfer will be completed within a fixed period.
7. Forex Cards
Forex cards offered through FXPertise may be issued and managed through the relevant card issuer or financial partner. Eligibility, KYC, issuance, loading and reloading, currency conversion, ATM withdrawals, card usage, fees, limits, card expiry, and blocking/replacement are governed by the applicable card issuer's or provider's terms and conditions, which will be made available to you as part of the card application/issuance process.
8. Travel Insurance
Travel insurance offered through FXPertise is provided subject to the terms of the applicable insurer, regulated by the Insurance Regulatory and Development Authority of India (IRDAI). Coverage, exclusions, claims, cancellation, premium, policy validity, and benefits are governed by the insurer's policy wording. FXPertise facilitates access to travel insurance products and does not guarantee the outcome of any insurance claim.
9. International SIM/eSIM
International SIM/eSIM services are subject to the selected plan, destination country, validity period, data allowance, network availability, device compatibility, activation requirements, and the applicable supplier/provider terms.
For eSIM services, you are responsible for ensuring that your device supports eSIM, is compatible with the selected network/service, is not carrier/network locked where applicable, and has appropriate connectivity available for activation. Once an eSIM has been activated or used, cancellation and refund eligibility may be restricted in accordance with the applicable service terms and our Cancellation & Refund Policy.
10. Forex as a Service (FaaS)
FXPertise's Forex as a Service (FaaS) offering may provide forex-related infrastructure and support to eligible business and channel partners. Access to FaaS is subject to eligibility review, onboarding, and applicable verification/compliance requirements. Specific commercial terms, pricing, and service levels for FaaS partners may be governed by separate agreements entered into between FXPertise and the relevant partner.
11. Exchange Rates and Pricing
- Currency exchange rates are dynamic and change with market conditions.
- Rates displayed on the website can change without notice prior to transaction confirmation.
- Taxes, service charges, banking charges, delivery charges, and other applicable fees may apply to a transaction.
- Third-party charges (for example, bank or payment gateway charges) may apply.
- The final payable amount will be shown and confirmed during the relevant transaction/order process.
12. Orders and Booking
- Submitting an order or request does not automatically mean it has been finally accepted by FXPertise.
- Orders may be subject to verification.
- FXPertise may request additional documents to process an order.
- FXPertise may contact you to confirm transaction details.
- Orders may be rejected or cancelled where legally or operationally necessary.
- A transaction becomes binding/confirmed in accordance with the applicable order confirmation process shown on the website or communicated to you.
13. KYC and Documentation
Depending on the service and transaction, you may be required to provide documents such as:
- PAN
- Passport
- Identity proof
- Address proof
- Visa / travel documents
- Air tickets
- Beneficiary documents
- Payment / account verification documents
- Other documents required for the specific transaction
Documents provided must be genuine, valid, accurate, legible, and current where applicable. FXPertise may reject or hold a transaction where required documentation is missing, inaccurate, expired, inconsistent, or unverifiable. Submission of forged or misleading documents is strictly prohibited and may result in refusal of service, cancellation of the transaction, and reporting to the relevant authorities where required by law.
14. Payment Terms
- Payments must be made through the payment methods supported on the website.
- Payment confirmation may be subject to confirmation from your bank or the payment gateway.
- A transaction is not considered successfully paid merely because a payment attempt was initiated.
- FXPertise may require proof of payment where applicable.
- Payment disputes may be investigated before a transaction is completed or refunded.
For regulated transactions, payments may also be subject to additional verification requirements under applicable law.
15. Taxes, TCS, GST and Other Charges
Transactions may be subject to GST, Tax Collected at Source (TCS), other applicable government levies, bank charges, payment gateway fees, service charges, correspondent/beneficiary bank charges, and other statutory charges, in accordance with applicable law and the specifics of the transaction. Applicable charges will be shown or confirmed as part of the relevant order/transaction process.
16. Rate Lock / Fixed Rate Orders
Rate-lock availability is subject to the applicable product/order. Where a rate-lock (fixed-rate) order is offered, a refundable rate-guarantee deposit may be required, and the fixed-rate order must be executed within the applicable validity period, as set out in our Cancellation & Refund Policy. The locked rate is subject to the terms of the applicable order, and failure to meet the required conditions (including timely completion of KYC, documentation, or payment) may result in cancellation or forfeiture of the deposit in accordance with that policy.
17. Cancellation and Refunds
Cancellation and refund eligibility varies by service and order type. The detailed rules governing cancellations, refunds, rate-lock deposits, turnaround times, and service-specific conditions (including for travel insurance and international SIM/eSIM orders) are set out in our Cancellation & Refund Policy, which forms part of, and should be read together with, these Terms & Conditions. In the event of any inconsistency regarding cancellation or refund matters, the Cancellation & Refund Policy shall apply.
18. Delivery and Collection
Physical currency, card, or document delivery or collection is subject to service availability, your location, payment confirmation, KYC completion, document verification, operational hours, holidays, and courier/logistics availability. Delivery timelines shown on the website or in an order confirmation are estimates unless expressly confirmed otherwise. Same-day delivery, where offered, is subject to the conditions shown on the website and/or your order confirmation.
19. Customer Responsibilities
You are responsible for:
- Providing accurate information
- Providing genuine documents
- Reviewing your transaction details before confirmation
- Ensuring your contact information is correct
- Ensuring beneficiary information is correct
- Keeping your account credentials secure
- Complying with applicable laws
- Not using FXPertise services for any unlawful purpose
20. Prohibited and Unlawful Transactions
FXPertise may refuse, suspend, or report transactions where required by law or applicable compliance requirements. Prohibited activity includes fraud, money laundering, terrorist financing, sanctions violations, use of forged documents, false identity, unauthorized transactions, unlawful foreign exchange activity, misuse of financial services, and transactions intended to evade applicable legal or regulatory requirements.
21. Regulatory Compliance
Relevant transactions may be subject to RBI requirements, FEMA, KYC requirements, AML requirements, applicable tax laws, applicable sanctions requirements, and other Indian laws and regulations. Where required by law or applicable compliance obligations, FXPertise may request additional information, delay processing, refuse a transaction, report a transaction to the relevant authorities, or suspend an account.
22. Third-Party Services
Certain services offered through FXPertise involve third parties, including banks, payment processors (such as our payment gateway partner, Cashfree), forex/remittance and card partners, insurers, international SIM/eSIM partners (such as Prune), courier providers, and technology providers. These third parties' services may be subject to their own separate terms and policies, and FXPertise is not responsible for the acts or omissions of independent third parties acting under their own terms.
23. Service Availability
The FXPertise website and services may occasionally be unavailable due to maintenance, technical problems, banking outages, payment gateway outages, partner/API failures, network problems, regulatory restrictions, market disruption, or force majeure events. FXPertise will make reasonable efforts to restore affected services as soon as practicable.
24. Electronic Communications
You may receive communications from FXPertise through email, WhatsApp (where applicable), phone, in-app notifications, and website notifications, for purposes such as order updates, payment updates, verification, customer support, security, and other service notifications. Marketing communications will only be sent where you have appropriately opted in or where otherwise legally permitted, and you may be given the option to opt out of such communications.
25. Intellectual Property
The FXPertise name, branding, logo, website design, text, graphics, images, software, and other content on the website are protected by applicable intellectual property laws. You may not reproduce, modify, distribute, scrape, copy, or commercially exploit any content from the website without FXPertise's prior written authorization, except where expressly permitted by law.
26. Website Content and Currency Rates
Information on the FXPertise website is provided for general informational purposes. Currency rates displayed on the website are dynamic and may change. Results shown by the currency converter are indicative and should not be treated as a guaranteed transaction quote. While FXPertise takes reasonable care in presenting website information, we do not represent that all website content is always error-free or up to date at every moment.
27. User Accounts and Security
Where FXPertise provides customer accounts (for example, through the "My Account" portal), you must:
- Provide accurate registration information
- Protect your login credentials
- Notify FXPertise promptly of any unauthorized access to your account
- Not share your account where prohibited
FXPertise may suspend account access where reasonably necessary for security or compliance reasons.
28. Privacy
Personal information you provide to FXPertise is collected, used, and protected in accordance with our Privacy Policy, which forms part of these Terms & Conditions.
29. Limitation of Liability
To the extent permitted by applicable law, FXPertise will not be responsible for losses arising from matters outside its reasonable control, including bank delays, payment processor failures, third-party service failures, network outages, incorrect information provided by you, device or connectivity issues affecting eSIM activation, regulatory restrictions, and force majeure events. Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law, including liability arising from fraud, wilful misconduct, or gross negligence.
30. Indemnification
To the extent permitted by applicable law, you agree to indemnify FXPertise against reasonable losses and claims directly arising from your violation of these Terms, unlawful use of the services, fraudulent activity, provision of false information, misuse of the website or services, or infringement of third-party rights caused by you.
31. Force Majeure
FXPertise shall not be held liable for any delay, failure, cancellation, suspension, or inability to process transactions arising due to events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government restrictions, RBI directives, banking network failures, payment network outages, internet or system failures, cyber incidents, currency market disruption, pandemics, or other unforeseen circumstances affecting forex operations or banking systems. This clause does not excuse FXPertise from obligations that could reasonably have been performed despite such an event.
32. Suspension and Termination
FXPertise may suspend or restrict services or accounts where necessary due to legal requirements, compliance concerns, suspicious activity, fraud, security risks, inaccurate information, violation of these Terms, non-payment, or misuse of services. Suspension or termination does not remove any obligations that accrued before the suspension or termination took effect.
33. Changes to Terms
FXPertise may update these Terms & Conditions from time to time. The latest version will be published at /terms-and-conditions, with the "Last Updated" date displayed at the top of this page. Where a change is material, FXPertise will use reasonable efforts to provide notice before the change takes effect.
34. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Subject to applicable law, courts at Ghaziabad, Uttar Pradesh, India shall have jurisdiction over disputes arising out of or in connection with these Terms.
